I recently found out I am involved in a civil lawsuit for a domain I purchased. I put a website up about how I was treated like dirt, and pointed gave other business addresses around the area to go to. I am not profiting from it, I don’t know any of the business owners, I was just unhappy with the owner who sent me out in tears over him not accepting a credit card wanting me to buy a limit of $10, when I asked why he ripped into me and belittled me. Long story short, I put the site up. I’m now being informed as a result I’m being taken to court over the misappropriation of their domain name, violation of the their protected tradename, the disparagement of their business, as well as a claim under the Anti-Cybersquatting Consumer Protection Act, 15 USCA 1125 (d).

I have searched the database, I can find no trademark. It’s a small business, one small building with about 3 or 4 employees which are spread through a 24 hour period.

My question is this, what do I do? I have no money, no job and can’t afford an attorney. If a judgment is issued, I have nothing. I own no home, the only thing I do have is a car, and old car. There is no income to garnish, though my wife works. Can they garnish her for it? What happens if I have nothing to garnish? I read they could seize my bank account, which would net them all of about 20 bucks most days. Is this something I should have an attorney, if so is there an organization that would help with representation? I’m in Michigan if the state matters.

Copyright or Trademark?

I have a dot com biz I am starting and am wondering what is the differences between intellectual properties. Example: mywebsite.com- should this be copyrighted? Trademarked? Registered TM? what about my web content on all the different pages?
also Liabilities? Any advise aside from contacting my local bar for an attorney or seek professional legal counsel?
